Our Expert Answers
Will my case be passed off to a beginner or an assistant?
No. At many law firms, a top lawyer will meet with you first, but then they pass your case to a beginner, a paralegal, or a completely different office. At Chico Law Pros, the attorney you hire will personally stay in charge of your case from start to finish. While an assistant might help out with paperwork at times, your lawyer is always the one running your case.
What is the difference between a Divorce and a Legal Separation?
A Divorce legally ends your marriage so you can completely move on with your life. A Legal Separation allows you and your spouse to live apart, but you stay legally married. One big advantage of a legal separation is that it protects you from being responsible for new debts your spouse might run up after you separate.
What does the court look at when deciding child custody?
California courts only care about what is best for the child. When a judge decides on custody and visitation, they will look closely at factors like how well the parents manage anger, any problems with alcohol or drugs, the parents’ lifestyles, and the child’s daily emotional and growing needs.
Can I change the amount of child support I pay or receive?
Yes, if your situation changes. Judges look at many different factors to decide support, including how much money both parents make, how much time each parent spends with the child, and any serious financial hardships. If you lose your job, make less money, or the other parent’s situation changes, you can ask the court to update your child support order.
What happens to my rights if someone files a restraining order against me?
You must act very quickly to defend yourself. If a judge grants a restraining order against you, it can cause severe, long-lasting consequences to your life. For example, you will immediately lose your second amendment right to own or carry a gun. It can also impact your child custody rights and force you to pay support.
